The Andalusian Department of Housing, Youth and Spatial Planning published a practical guide to the urban development agent, a role provided for under the Law to Promote the Sustainability of the Territory of Andalusia (LISTA). The department said the guide is intended to help municipalities and operators apply the law, support the mobilisation of land and speed up implementation of urban plans.

Housing Minister Rocío Díaz announced the guide’s preparation at an urban planning forum in Málaga last September, describing it as an “instruction manual” to explain who can serve as an urban development agent, when the role may be used and what procedures apply. The guide sets out legal and practical issues in ten chapters, including the agent’s status, selection and award procedures, participation in different urban development systems, and the physical execution of urbanisation works.

An urban development agent may be an individual or legal entity that does not own the land or hold a majority interest. After being selected by the public administration through a competitive process, the agent may take responsibility for carrying out an urban development project. The guide identifies public competition and proof of economic, financial, technical and professional capacity as essential requirements. Private operators participate within a framework of public direction, supervision and control.

The guide covers the agent’s use in both systematic and non-systematic urban management, as well as in public expropriation systems and projects on urban land that do not require the creation of an execution unit. The role may also be used in certain urban improvement and redevelopment projects, and in the provision of facilities and infrastructure.

Municipalities are generally responsible for selecting the agent, although the Andalusian regional government may do so in certain cases of regional interest. The guide outlines award criteria including delivery times, costs borne by landowners, construction quality, performance guarantees, the operator’s capacity and commitments relating to protected housing.
